Terms of Service
These terms govern the web design, development, hosting and related digital services offered by MTJ Digital. By accepting a quote, making a payment or using our services, you agree to these terms.

1. About MTJ Digital
MTJ Digital is a trading name of Max Van Nieuwenhuizen, a sole proprietor based in Gauteng, South Africa. Our physical address is 13 Maroela Road, Dal Fouche, Springs, Gauteng, 1559, South Africa. Our contact email is [email protected].
2. Services
We provide digital services including, but not limited to, custom web design and development, website hosting and maintenance, search engine optimisation, Google Business Profile management, local citation building, lead-magnet creation, domain registration and management, analytics setup, and print-design coordination.
All services are described in the written quote, project scope or care-plan agreement provided before work begins. Any service not explicitly included in that scope is excluded unless agreed in writing.
3. Quotes, deposits and payment
- All quotes are fixed-price unless clearly marked as estimated or hourly.
- Website build projects require a 50% deposit to begin, with the remaining 50% due on launch.
- Monthly care plans, hosting and retainer services are billed in advance.
- Domains, third-party plugins and stock assets are billed as separate line items when purchased.
- Invoices are payable within 7 days unless otherwise stated. Late payments may delay delivery or suspend active services.
4. Refund policy
Project deposits are non-refundable. Once work has begun, the deposit covers strategy, design, development time and reserved capacity.
Where a refund is agreed in writing for any other payment, it will be processed within 7 business days of written notice, via EFT to a South African bank account nominated by the client.
Domains and third-party fees (registrar costs, plugin licences, stock imagery, paid directory submissions) are non-refundable once paid to the relevant supplier.
5. Cancellation policy
Website projects: A client may cancel a project at any time. The 50% deposit is retained by MTJ Digital. Any additional completed work beyond the deposit value may be invoiced before files are handed over.
Care plans and retainers: These are month-to-month. You may cancel by giving 30 days' written notice. If the 30-day notice period falls within the next billing cycle, that next cycle will be charged in full and cancellation will take effect at the end of that cycle.
Hosting: If hosting is cancelled without an active care plan, responsibility for migrating the site transfers to the client. We will provide a reasonable export window.
6. Delivery
MTJ Digital sells digital services only. There are no physical deliveries. Deliverables are supplied electronically — via file transfer, version-control repository, deployment to a live URL, or email — as described in the project scope.
Project timelines are estimates based on prompt client feedback. Delays caused by late content, approvals or third-party access may extend the delivery date without penalty to MTJ Digital.
7. Intellectual property
Upon final payment, the client owns the final website design, content and code produced specifically for the project, excluding third-party code, plugins, fonts and stock assets licensed under their own terms.
MTJ Digital retains the right to display the completed work in our portfolio, on our website and in marketing materials unless the client requests otherwise in writing before the project begins.
Source files, prototypes and internal working documents remain the property of MTJ Digital unless explicitly included in the deliverables.
8. Client responsibilities
The client agrees to provide timely access, content, feedback and approvals needed to complete the project. The client is responsible for the accuracy of all content and data supplied, and for obtaining any necessary rights to materials they provide.
9. Limitation of liability
MTJ Digital's total liability for any claim arising from our services is limited to the amount paid by the client for those specific services in the 12 months preceding the claim. We are not liable for indirect, consequential or lost-profit damages, or for issues caused by third-party services, client content or unauthorised modifications made after handover.
10. Termination by MTJ Digital
We may suspend or terminate services immediately if a client fails to pay, provides unlawful content, breaches these terms, or acts abusively toward our team. In such cases, no refund will be due for work already completed or deposits paid.
11. Governing law
These terms are governed by the laws of the Republic of South Africa. Any dispute will be resolved in good faith through negotiation, and if necessary, through the courts of South Africa. Data protection practices are explained in our Privacy Policy, which complies with the Protection of Personal Information Act 4 of 2013 (POPIA) and, where applicable, the EU General Data Protection Regulation (GDPR).
12. Changes to these terms
We may update these terms from time to time. The current version will always be published on this page with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated terms.
